For the purchase of products and services made remotely by the buyer through the website baciuccocalzature.it, owned by BACIUCCO ANTONIO, located at VIA ROMA, 95, BASTARDO - GIANO DELL'UMBRIA, VAT number IT01176730545, the following conditions apply.
The Customer is required, before submitting their purchase order, to carefully read these General Terms and Conditions of Sale.
The submission of the purchase order implies full knowledge and express acceptance of both these General Terms and Conditions of Sale and the contents of the Order Form.
The Customer is required, once the online purchase procedure is completed, to print and keep these general terms and conditions of sale and the related order form, already viewed and accepted.
BACIUCCO ANTONIO reserves the right to update, at any time and without notice, its General Terms and Conditions of Sale and, therefore, each order will be subject to the terms and conditions in force on the Site at the time the order is placed by the Consumer.
GENERAL TERMS AND CONDITIONS OF SALE
(Hereinafter referred to as “Customer”): these general contractual conditions govern all relationships between BACIUCCO ANTONIO and the “Customer.” These “General Terms and Conditions of Sale” form an integral and substantial part of every proposal, order, and order confirmation for the purchase of products by the “Customer” and will become part of all the general sales conditions on BACIUCCO ANTONIO’s website.
The “Customers” of the website must register and expressly accept the “General Terms and Conditions of Sale” set out in this document. Purchases are reserved for private consumer users, as defined by Art. 3 of the Consumer Code (Legislative Decree 206 of 6/09/2005), i.e., natural persons acting for purposes unrelated to any business or professional activity they may perform. Therefore, all individuals not falling under the definition of private consumers or users are asked to refrain from registering and to contact BACIUCCO ANTONIO directly to arrange a specific agreement.
To place orders, the “Customer” must meet the following requirements:
Providing the requested data at the time of registration is mandatory for the “Customer” as it is strictly functional to the related activities. Any refusal to provide such data will result in BACIUCCO ANTONIO being unable to activate the services and perform all related activities.
By creating an account, the “Customer,” in addition to providing essential data for the execution of the contract and thereby consenting to the receipt of so-called transactional emails, also agrees to receive from BACIUCCO ANTONIO, at the email address provided at registration, commercial communications and proposals, specifically the Newsletter; so-called promotional emails.
At any time, the “Customer” can click on the appropriate link at the bottom of the commercial communication to opt out of receiving further promotional communications.
For all individuals subscribing to the Newsletter, it is specified that the subscription does not in any way imply the initiation of a commercial relationship with BACIUCCO ANTONIO, and consent can be revoked at any time by sending an email communication to the company.
In compliance with Legislative Decree 70 of 09/04/2003, which contains provisions on electronic commerce, BACIUCCO ANTONIO informs the “Customer” that to conclude the product purchase contract, the “Customer” must fill in an electronic order form and submit it electronically, following the instructions displayed from time to time on the “Site” during the various purchase stages.
If the “Customer” wishes to receive an invoice, they must fill in the appropriate fields in the order form with their tax domicile, tax code, VAT number, and unique code.
The contract is concluded when BACIUCCO ANTONIO registers the order form, after verifying the correctness of the order and payment details.
Before submitting the order form, the “Customer” can identify and correct any data entry errors using the automatic checking system, following the instructions provided during the various purchase steps indicated on the “Site.”
If there are errors and/or omissions, the system will automatically alert the customer and prevent the order from being submitted.
Once the order form is registered, a confirmation of the order and the payment receipt will be sent to the “Customer” at the email address provided during registration. It is recommended to keep the received email as proof of purchase.
The order form, before being confirmed, will indicate quantities, codes, and descriptions of individual products and services, prices, any applicable taxes and charges.
Each product code will correspond to technical descriptions, models, materials, sizes, and colors of the products as per the technical sheet for the individual product and its variants.
For each product or product type, when added to the “shopping cart,” the delivery and packaging costs, payment methods, and applicability of these “General Terms and Conditions of Sale” will be indicated, as required by Art. 52 of the Consumer Code (Legislative Decree 206 of 6/09/2005).
It may happen that the ordered product is no longer available after the purchase order is placed. In such a case, the “Customer” will be promptly informed and refunded the amount paid, in any case no later than 30 days from the date of payment, with retroactive value to that date.
If a “Customer” has submitted orders for multiple products and only some are available, BACIUCCO ANTONIO has the right to make a partial delivery.
For each Product offered for sale on the Site, an image of the Product will be shown on the Site, along with the unit price, available colors, and sizes. Product images are provided purely for illustrative purposes.
The images and colors of the Products offered for sale on the Site may not match the actual ones due to the browser and/or monitor used or for other technical reasons. BACIUCCO ANTONIO is not responsible for any inadequacy of the graphic representations of the Products shown on the Site due to the aforementioned technical reasons.
The Prices indicated on the Site for the Products include VAT as required by law, but not shipping and delivery costs throughout the national territory, which will be added to the total amount due: shipping costs are detailed during the payment procedure and are therefore considered accepted by the Consumer when the Order is submitted.
BACIUCCO ANTONIO reserves the right to change its prices at any time and without notice, it being understood that, for Orders being accepted or already accepted, the prices in effect at the time of the Order submission by the Consumer will apply. Product prices may vary between the Site and physical stores.
Before purchasing, it will be possible to view the shipping costs to be borne by the customer. Payment can be made via:
The amount is debited when the transaction is completed, and an automatic notification email is sent to the customer's email address. In case of order cancellation, the amount will be refunded to the customer’s bank account.
Credit card data is entered directly on the pages of the bank partner chosen for the online store and transmitted to the bank’s servers in encrypted form using the 128-bit SSL (Secure Socket Layer) standard, one of the most advanced and effective protection systems currently available.
For greater security, only the banking partner has access to the card data used for payment.
By selecting the “Pay” button during the purchase process, the “Customer” declares to fully and unconditionally accept all of these “General Terms and Conditions of Sale.”
For credit card payments, once the Order is received, BACIUCCO ANTONIO will perform a pre-authorization on the Consumer’s credit card to ensure the latter has sufficient funds to complete the transaction. The card will be charged at the time of shipment of the Order, at which point the Consumer will be notified with a Shipping Confirmation.
Credit cards will be subject to checks and authorizations by the issuing entity. BACIUCCO ANTONIO shall not be liable for any non-authorization by the issuing entity and, if such entity does not authorize the payment, BACIUCCO ANTONIO shall not be responsible for any delay or non-delivery, and no contract can be concluded with the Consumer.
PayPal: at the time of purchase, you will be redirected to PayPal's secure payment page. You can then proceed with the payment directly using your PayPal account, and the corresponding amount will be charged to your PayPal account at the time the order is placed.
In the event of order cancellation, the amount will be refunded to the customer's PayPal account. BACIUCCO ANTONIO accepts payments only from verified PayPal accounts and reserves the right to ship only to the address indicated on the verified PayPal account. All other orders placed with unverified accounts will be cancelled.
BACIUCCO ANTONIO reserves the right to check the validity of the PayPal account and whether sufficient funds are available to complete the purchase. The corresponding amount will be held on the account for 72 hours and charged at the time of shipment of the Products to the Consumer, who will be notified via a Shipping Confirmation.
If the amount is no longer available at the time of the charge, the order will be cancelled.
Product purchase orders will be processed only after BACIUCCO ANTONIO receives confirmation of full payment, including shipping costs. The products remain the property of BACIUCCO ANTONIO until the full amount due is paid.
The delivery time will begin from the date of payment confirmation.
The electronic format of the order completed and submitted online by the Customer will be considered an irrevocable purchase proposal.
The receipt of the order by BACIUCCO ANTONIO does not constitute acceptance of the purchase proposal, but merely confirms that the order has been received and is undergoing verification of data and product availability.
The contract is concluded only when the Customer receives the Shipping Confirmation email.
BACIUCCO ANTONIO reserves the right, at its sole discretion, to refuse orders from Customers who do not provide sufficient guarantees of solvency, have pending disputes, or exhibit anomalous purchasing behavior.
BACIUCCO ANTONIO also reserves the right, at its sole discretion, to limit the number of products that each Customer can purchase and to set a maximum spending limit per Customer.
In the event that a product is unavailable, the Customer will be promptly informed via email, and the provisions of Article 3 will apply.
Once the purchase order is confirmed, the Customer will be able to view the order details at any time in the relevant web page. BACIUCCO ANTONIO remains available to facilitate such viewing even if the product has been temporarily removed from the catalog after the order was placed.
If the Products ordered by the Customer are temporarily unavailable, BACIUCCO ANTONIO will inform the Customer via email by the next business day after the order was placed. If the Products are not available, the Customer’s payment card will not be charged. If the purchase amount has already been charged, a refund will be issued within 14 (fourteen) days to the payment card used to place the order.
Please note that banking times must be taken into account for the visibility of the refund, depending on the conditions of the relevant banking institution. BACIUCCO ANTONIO has no control over the refund timing, which is at the discretion of the bank.
BACIUCCO ANTONIO undertakes to supply products corresponding to the product sheets published, compliant with their technical specifications and current regulations, and free from defects or faults.
The products will always be new and of "first choice", unless otherwise clearly stated in advance.
The warranty period for the products begins on the date of delivery to the Customer.
In case of product non-conformity, the Customer has the right to request a replacement at no additional cost, provided that this is possible in relation to the availability of stock and unless the replacement is overly burdensome for BACIUCCO ANTONIO, considering the extent of the defect and the value of the product without the defect.
For replacement, the consumer may choose between repair and replacement, provided that the chosen remedy is not impossible or excessively costly for the seller, taking into account:
Alternatively, the Customer has the right to a proportional price reduction or to contract termination.
In the case of contract termination, BACIUCCO ANTONIO will refund the amount paid by the Customer, including shipping costs, within 30 (thirty) days from the date of the termination notice.
In the case of a price reduction, BACIUCCO ANTONIO will refund the amount reduced under the same terms as above.
The refund amount will be communicated to the Customer via email and credited based on the agreements made between the Parties.
The Customer must agree with BACIUCCO ANTONIO's Service Team on the shipping methods for returning the goods.
The warranties relating to the products sold are those provided directly by the manufacturer.
The Customer must report any non-conformities (apparent defects) to BACIUCCO ANTONIO within 2 months of their discovery, otherwise the warranty will expire.
For hidden defects, the legal terms will apply.
The conformity warranty does not apply to products that have been repaired, modified, or otherwise altered by the Customer.
BACIUCCO ANTONIO is not liable for any damages of any kind arising from improper installation and/or use of the product not in accordance with the manufacturer’s instructions, as well as for damages resulting from force majeure.
Product images and colors published on the Site may differ from the actual items due to the local settings of the systems and/or tools used by Customers to view them.
BACIUCCO ANTONIO is also responsible for the "Product Conformity Guarantee": any non-conformity of the purchased product as provided by the Consumer Code (Title III – Legal guarantee of conformity and commercial guarantees for consumer goods, Chapter I – Sale of consumer goods, Articles 128 et seq. of Legislative Decree 22.07.2005 No. 206), provided that it existed at the time of delivery and becomes apparent within two years of receipt, and that it was not known to the Customer at the time of purchase.
Each defect must be reported to BACIUCCO ANTONIO within two months of its discovery by sending a registered letter with return receipt to VIA ROMA, 95, BASTARDO - GIANO DELL'UMBRIA or by email to baciuccocalzature@gmail.com. The date of the postal stamp will serve as proof.
To claim the warranty, it is necessary to keep the invoice or sales document delivered with the package and contact our customer service at baciuccocalzature@gmail.com.
BACIUCCO ANTONIO will deliver, at the “Customer’s” expense, via its own couriers to the address indicated by the “Customer” during the order process (except for orders paid with verified PayPal).
Upon delivery of the products, the “Customer” must verify:
Any damage or discrepancy in the number of packages or indications must be immediately reported to the courier making the delivery.
If the recipient is absent at the time of delivery, a notice will be left and the “Customer” must promptly contact the courier to arrange a new delivery method.
All “Customers” placing an order establish a commercial relationship and therefore agree to accept delivery of their package.
If, for any reason, the “Customer” refuses delivery or requests return to sender, they will be held responsible for shipping, storage and retrieval costs, which will be deducted from any refund due.
BACIUCCO ANTONIO is not responsible for delayed or failed delivery due to force majeure or unforeseen events.
Products will be delivered in standard packaging, including documentation such as instruction manuals. Delivery is made via trusted couriers at the shipping cost shown during order checkout, calculated based on the weight, volume and destination of the goods. The shipping cost is borne by the “Customer” according to the rates provided.
BACIUCCO ANTONIO commits to doing everything within its power to deliver the Product(s) by the date indicated in the Shipping Confirmation. However, delivery and shipping times stated in the confirmation are indicative and not binding; therefore, BACIUCCO ANTONIO assumes no responsibility for delays. Product risk transfers to the Consumer upon delivery to the Consumer or to a third party, other than the carrier, designated by the Consumer. At delivery, the Consumer must sign the delivery slip and note any issues such as visible damage or signs of tampering with the packaging. If the Consumer signs with specific reservations due to visible packaging damage (wet, punctured, torn, etc.) and/or upon opening finds the Products damaged, incorrect or missing, they must notify BACIUCCO ANTONIO immediately and in any case within 5 calendar days of delivery. After this period, transport-related claims will no longer be accepted.
These are distance selling contracts governed by the Consumer Code (Legislative Decree 206 of 6/09/2005). The “Customer” has the right to withdraw, meaning they can return the purchased product and receive a refund. In accordance with Article 49 of the Consumer Code – Legislative Decree no. 206/2005.
Exercise of the right. The Consumer has the right to withdraw from the purchase without providing any reason and without penalty, within 14 calendar days from the day the Consumer, or a third party designated by them who is not the courier, receives the ordered Product. The delivery receipt date at the agreed shipping address will apply. If the deadline falls on a Saturday, Sunday or holiday, it is extended to the next working day. To exercise this right, the “Customer” must send a written communication within the timeframe to VIA ROMA, 95, BASTARDO - GIANO DELL'UMBRIA via registered mail with return receipt or email: baciuccocalzature@gmail.com. After exercising the right of withdrawal, the Consumer must return the Products to BACIUCCO ANTONIO as soon as possible and in any case within 14 calendar days from the date of the withdrawal communication. If the Consumer fails to return the Products within this period, BACIUCCO ANTONIO reserves the right to reject the return and withhold any refund. Once the products are received and verified to be intact, the Seller will process the refund within 14 days, using the method stated in the withdrawal communication. For cash-on-delivery orders, BACIUCCO ANTONIO reserves the right to deduct return shipping costs. BACIUCCO ANTONIO reserves the right to refuse returns without a return authorization code. Upon receipt of the return form by BACIUCCO ANTONIO, the parties are released from their obligations except for product and price return. As per Art. 67 of the Consumer Code (Legislative Decree 206 of 6/09/2005), substantial integrity of the products is essential to exercise the right of withdrawal.
Terms and conditions:
To minimize damage to the original packaging, we recommend placing it in a secondary box, marking the return number (return authorization code) on it. Do not attach labels or tape directly on the original product packaging.
Until proof of delivery to our warehouse, shipment is under the full responsibility of the “Customer”; therefore, BACIUCCO ANTONIO is not responsible for any damage, theft or loss of returned goods from uninsured shipments.
All returned items will be inspected by BACIUCCO ANTONIO and must meet the conditions listed above and the return procedure in these Terms of Sale. BACIUCCO ANTONIO reserves the right to charge 10% of the product value if the return does not meet the stated requirements. Unauthorised returns may be refused or accepted with a 10% charge applied to the “Customer.”
BACIUCCO CALZATURE shipments to Italy, San Marino, Vatican City and the Islands are made via express courier GLS (delivery in 2/3 working days) and MAILBOXESETC (SDA), and are completely free for amounts over €100.
Shipments to Europe are made via GLS and MAILBOXESETC couriers at a cost of €18.00.
Shipments to non-European countries are made via GLS and MAILBOXESETC at a cost of €25.00.
If you're not satisfied with your purchase, you have 14 days from receiving the goods (as required by Article 52 of the Consumer Code) to return the product, request a return, ship the package, and have it delivered to us (the returned goods must be delivered to our office no later than 14 days after the order was delivered). We recommend that you proceed well in advance to meet the established deadlines.
Returns will be accepted under the following conditions:
To make an exchange, you have the right to change size within 7 days of the order delivery date.
To return/exchange the product, send us an email to our Customer Service baciuccocalzature@gmail.com Please provide your name, surname, and order number. You will receive an email within 48 hours with all the instructions for returning/exchanging your order.
To process returns, BACIUCCO CALZATURE uses the GLS E MAILBOXESETC (SDA) courier at a cost of €8.
Refund Issuance:
After receiving and inspecting your return, BACIUCCO CALZATURE will refund your returned items. A €8.00 return shipping fee will be deducted from the refund for GLS and MAILBOXESETC (SDA) courier services.
The refund will be visible within 7 days of its issuance on the account used at the time of purchase. The timeframe may vary slightly depending on the banking circuit of the credit card used.
Please note that any initial shipping costs incurred to receive your order and any cash on delivery charges will never be refunded.
Returns from abroad:
If you are outside of Italy, you will need to ship the item yourself by booking a courier of your choice. Once you send us an email requesting the return, including your name, surname, and order number, we will reply with a confirmation email and shipping address. Any customs fees are the buyer's responsibility.
BACIUCCO ANTONIO shall not be liable to the “Customer” or third parties for damages, losses or costs resulting from failure to execute the contract; the “Customer” will only be entitled to a refund of the price paid. Similarly, BACIUCCO ANTONIO is not liable for any fraudulent or illegal use of credit cards or other payment methods by third parties. BACIUCCO ANTONIO does not have access to credit card numbers, which are securely transmitted to the payment provider via SSL protocol. In case of force majeure, the defaulting party shall not be held liable, provided it made reasonable efforts to perform its obligations. Force majeure includes events beyond the control of one or both parties (e.g., war, riots, fires, floods, earthquakes, strikes, or government orders) preventing proper fulfillment of obligations.
Personal data provided by the Consumer will be processed in accordance with the privacy policy available on the Website, in compliance with EU Regulation 679/2016. The Website offers the option to purchase Products as a guest. Only essential data will be collected for order processing and invoicing. Upon completing the purchase, the user may register or continue as a guest.
These General Conditions and any document referenced herein represent the entire agreement between the Consumer and BACIUCCO ANTONIO regarding the Contract and replace any previous agreements, verbal or written.
The applicable law requires some communications to be in writing. The Consumer agrees that most communication with BACIUCCO ANTONIO will be in electronic format, thus satisfying the legal requirement of written form. If one or more provisions of these Terms are found invalid by a court, the remaining provisions will remain in full force and effect.
Under privacy regulations, your personal data will be processed by BACIUCCO ANTONIO (data controller). The data you voluntarily provide will be stored on both paper and electronic media. Processing will be carried out by the data controller and those under its authority in accordance with privacy laws. Providing data is optional. Your data will be kept confidential and only as long as necessary. Appropriate security measures will be taken to prevent data loss, misuse or unauthorized access. Data will not be disclosed.
Having read the privacy policy, I AUTHORIZE BACIUCCO ANTONIO to send commercial and promotional material, including via email.
This contract shall be interpreted and governed in accordance with Italian law. Matters not expressly covered herein shall be governed by the Italian Civil Code. For any disputes regarding interpretation and/or execution of this contract, the Court of Perugia shall have exclusive jurisdiction.
